State governments provide preprinted advance directive forms to the general public. However, many adults in the United States (US) lack the skills necessary to read and comprehend health care-related materials. In this study, we sought to determine the readability of state government-sponsored advance directive forms.

I discuss the knowledge account of legal proof in Moss (2023) and develop an alternative. The unifying thread throughout this article are reflections on the beyond reasonable doubt (BRD) standard of proof. In Section 1, I will introduce the details of Moss’s account and how she motivates it via the BRD standard. In Section 2, I will argue that there are important disanalogies between BRD and knowledge that undermine Moss’s argument. There is however another motivation for the knowledge account: combined (...) with auxiliary claims, that is probabilistic knowledge and moral encroachment, it can provide a general solution to the puzzle of statistical evidence. Section 3 spells out the details. In Section 4, I suggest to combine the knowledge account with pragmatic encroachment, instead of moral encroachment, in order to stay clear of the thorny issues whether corporations have moral rights. In Section 5, I argue that the verdicts of Moss’s account in cases of false justified beliefs and non-luminous knowledge conflict with the BRD standard and thus call for abandoning the account. Based on the social function of the BRD standard, I suggest a replacement for the knowledge account that is also just as potent as a general solution for the puzzle of statistical evidence. While I will grant that knowledge is neither always necessary nor always sufficient for convictions, I will argue that the concept of knowledge nonetheless plays a significant and ineliminable role in legal decision-making. P.After some 30 years of incisive intervention in Platonic scholarship, Holger Thesleff here offers us "an attempt to elaborate and ground more firmly some basic theses which I have propounded in various contexts before," (1) a rather modest description of what he also describes as an (...) attempt to contribute toward "a more general agreement on how to read and interpret Plato" (5). The richness of this book makes it impossible to describe in any detail, and I shall content myself with indicating some of what I take to be its principal points of view.Thesleff"s concern for agreement arises from his perception of the vastly discrepant schools of Plato interpretation, of which the most important for him might be labeled esotericist, analytic, and "literary." The last, which can hardly be called a school at all, includes a variety of scholars who downplay "literal" interpretation and emphasize such things as "dramatic artistry, the structure of the dialogues, the characterization of settings and persons, shifts of style, allusions, play, and irony" (3). Thesleff's sympathies clearly lie with these people, perhaps to an extent which, as I shall suggest, will limit the effectiveness of his attempt to move toward a consensus.As the title indicates Thesleff builds his reading around what he calls Plato's two-level model. This two-level model is not, as one might suppose, what has been called Plato's two worlds view, the belief in a world of pure being beyond the perceived world we inhabit. Indeed, it is not a doctrine or set of doctrines at all. Rather "it is an intuitive 'vision' which offers only crude basic patterns and frames for the structures of Plato's thinking, feelings, intuitions, and intentions, from his youth to his old age, and for our understanding of them" (123). Clearly one cannot expect a full and precise articulation of this vision. Thesleff proceeds by discussing in terms of their role in the earlier dialogues ten hierarchic pairs which form part of Plato's vision: divine/human, soul/body, leading/being led (particularly important in the conduct of a Socratic discussion), truth/appearance, knowledge/opinion, intellect/senses, defined/undefined, stability/change, one/many, same/different. These hierarchic or asymmetric pairs are contrasted by Thesleff with what he calls polar opposites like large/small and light/dark. He also stresses that the hierarchic pairs of Plato's two-level model involve no separation (chorismos), but rather a communion (koinônia).As the words "from his youth to his old age" in the quotation of the previous paragraph indicate, Thesleff is a "unitarian" in his approach to Plato. His Plato is not a philosopher whose positions changed through time as a result of reasoned argument. What many scholars take to be doctrines later given up, e.g., the view that learning is being reminded (anamnêsis), are "thought experiments," which are not followed up, thought experiments made within the context of the unchanging two-level vision.Although Thesleff is a unitarian in the sense I have indicated, he does believe that a kind of order of composition can be constructed for the dialogues. I say "kind of" because Thesleff's chronology involves assumptions of revisions over time, multiple authorship, and even dialogues "written down" by people other than Plato. Recent scholarship emphasizes the scaffolding role of language for cognition. Language, it is claimed, is a cognition-enhancing niche (Clark, 2006), a programming tool for cognition (Lupyan and Bergen, 2016), even a neuroenhancement (Dove, 2019), and augments cognitive functions such as memory, categorization, cognitive control as well as meta-cognitive abilities (‘thinking about thinking’). Yet the notion that language enhances or augments cognition does not fit in with embodied approaches to language processing, or so we will argue. Accounts aiming to explain how (...) language enhances various cognitive functions often employ a notion of abstract representation. Yet embodied approaches to language processing have it that language processing crucially, according to some accounts even exclusively, involves embodied, modality-specific, i.e. non-abstract representations. In coming to understand a particular phrase or sentence, a prior experience has to be simulated or reenacted. The representation thus activated is embodied (modality-specific) as sensorimotor regions of the brain are thereby recruited. In the paper, we will first discuss the notion of representation, clarify what it takes for a representation to be embodied or abstract respectively, and distinguish between conceptual and (other) linguistic representations. We will then put forward a characterization of cognitive control and examine its representational infrastructure. The remainder of the paper will be devoted to arguing that language augments cognitive control. To that end, we will draw on two lines of research, which investigate how language augments cognitive control: i. research on the availability of linguistic labels, and ii. research on the active usage of a linguistic code, specifically in inner speech. Eventually, we will argue that the cognition-enhancing capacity of language can be explained once we assume that it provides us with a. abstract, non-embodied representations, and with b. abstract, sparse linguistic representations that may serve as easy-to-manipulate placeholders for fully embodied or otherwise more detailed representations. The work on moral development by Harvard educator Carol (...) Gilligan in her book, In a Different Voice, is pivotal in this discussion (IV B, Cooper 1989). Jean Watson, a nurse at the University of Colorado Center for Human Caring, also has written extensively on the philosophy of caring. She states that "an ethic of caring has a distinct moral position: caring is attending and relating to a person in such a way that the person is protected from being reduced to the moral status of objects...." It is a popular thought that emotions play an important epistemic role. Thus, a considerable number of philosophers find it compelling to suppose that emotions apprehend the value of objects and events in our surroundings. I refer to this view as the Epistemic View of emotion. In this paper, my concern is with a rivaling picture of emotion, which has so far received much less attention. On this account, emotions do not constitute a form of epistemic access to specific axiological (...) aspects of their objects. Instead it proposes that they are ways of taking a stand or position on the world. I refer to this as the Position-Taking View of emotion. Whilst some authors seem sympathetic to this view, this it has so far not been systematically motivated and elaborated. In this paper, I fill this gap and propose a more adequate account of our emotional engagement with the world than the predominant epistemic paradigm. I start by highlighting the specific way in which emotions are directed at something, which I contrast with the intentionality of perception and other forms of apprehension. I then go on to offer a specific account of the valence of emotion and show how this account and the directedness of emotions makes them intelligible as a way of taking a position on something. The philosophy of the art of living asks the age-old question of orienting one’s own life: ‘How can I live well?’ An art of living is always called for when people do not know what to do and how to go on, when the ways of life are no longer self-evident, when traditions, conventions, rules, and norms lose their plausibility and individuals begin to worry about themselves. The art of living and of its philosophy has a practical aim: It is (...) not concerned with ethical principles, but with the concrete practice of people’s everyday life, with their individual and successful lives. Friedrich Nietzsche, as he often did, pushed the problem of the art of living to the extreme, making it palpable both in its dignity and in its force. For him, the modern uncertainty of human orientation caused by nihilism pointed to art and aesthetics, which, he supposed, makes life if not justifiable, at least bearable. The arts open up a multi-perspectival seeing and hearing, they experiment with alternative forms and techniques, and create the finest sensibilities for both – Nietzsche himself, with his rich forms of philosophical writing, is an outstanding example of this. -/- The volume we present here, entails contributions of German-speaking scholars on Nietzsche and the ways of living he proposes, especially, but not alone in Dawn. Before sampling some of the treasures, I must register three objections: one unessential, the other two less so. Bern, in the eighteenth century, was not a ‘Canton’ - it became that in 1848 - but a sovereign state. And the French spelling ‘Berne’ is not used in the German-speaking Bern. Many repetitions of the same mistake do not make it more correct. Secondly, the author has taken over from Theodor Haering his contention that the unifying interest of the young Hegel (...) was his concern for popular education. If there is one realm of value which Hegel did not cultivate, it would be just that. If one wants to know what it is for a man to concern himself with Volkserziehung, then he must get acquainted with Pestalozzi, who was at the height of his activity when Hegel resided in Switzerland. He did not notice him. In Glockner’s Hegel Lexicon there are only two references to Pestalozzi, both of them irrelevant. When Hegel speaks of education, it is always the humanistic and philosophical education of intellectuals. Finally, the author is aware of my criticism of the nineteenth century translation of ‘Verstand’ by ‘understanding’, and of ‘Vernunft’ by ‘reason’. But he ignores it and clings to the traditional nineteenth century mistake. But the equivalent of ‘understanding’ - hallowed perhaps by Locke’s Essay Concerning Human Understanding - is nevertheless not ‘der Verstand’ but ‘das Verstehn’ - the felt apprehension of values or their lack in other souls. ‘Verstand’, in Hegel, is always ‘reason’, as defined by formal logic, and ‘Vernunft’ is never ‘reason’, but always self-conscious or reflective comprehensiveness. I will argue for a novel variant of the knowledge norm for practical reasoning. In Sect. 2, I will look at current variations of a knowledge norm for practical reasoning and I will provide reasons to doubt these proposals. In Sects. 3 and 4, I develop my own proposal according to which knowledge is the norm of apt practical reasoning. Section 5 considers objections. Finally, Sect. 6 concerns the normativity of my proposed knowledge norm and its significance.

Goethe's objections to Newton's theory of light and colours are better than often acknowledged. You can accept the most important elements of these objections without disagreeing with Newton about light and colours. As I will argue, Goethe exposed a crucial weakness of Newton's methodological self-assessment. Newton believed that with the help of his prism experiments, he could prove that sunlight was composed of variously coloured rays of light. Goethe showed that this step from observation to theory is more problematic than (...) Newton wanted to admit. By insisting that the step to theory is not forced upon us by the phenomena, Goethe revealed our own free, creative contribution to theory construction. And Goethe's insight is surprisingly significant, because he correctly claimed that all of the results of Newton's prism experiments fit a theoretical alternative equally well. Bobier argued that hope is necessary for practical deliberation. I will demonstrate that Bobier’s argument for this thesis fails. The problem is that one of its main premisses rests on a sufficient condition for hoping that is subject to counterexamples. I consider two ways to save the argument, but show that they are unsuccessful in doing so.

This contribution focuses on three aspects of Nietzsche’s art of living that have become relevant today especially in the United States (but not only here): first, regarding some facets of the economic-political conditions of any contemporary art of living; second, the widespread adoption of Nietzsche’s notion of self-overcoming and artistic self-design in entrepreneurship and individual’s lives; and third, how his notion of ‘incorporation’ has been further developed in current approaches to habit design. Eventually I will show via the example of (...) Anthony Robbins that some notions of Nietzsche’s art of living have become most popular outside of academia, namely in the commercial industries of what has been called ‘self-growth’ or ‘self-development.’. I argue against Schroeder's explanation of pragmatic encroachment on knowledge. In section 1, I introduce pragmatic encroachment and point out that an explanation of it should avoid Pascalian considerations. In section 2, summarize the key aspects of Schroeder's explanation of pragmatic encroachment. In section 3, I argue that Schroeder's explanation faces a dilemma: it either allows for an objectionable form of Pascalian encroachment or it fails to be a fully general explanation of pragmatic encroachment.

Research on the cognitive abilities involved in decision making has shown that, under objective risk conditions (i.e., when explicit information about possible outcomes and risks is available), superior decisions are especially predicted by executive functions and exact number processing skills, also referred to as objective numeracy. So far, decision-making research has mainly focused on exact number processing skills, such as performing calculations or transformations of symbolic numbers. There is evidence that such exact numeric skills are based on approximate number processing (...) (ANP) skills, which enable quick and accurate processing of non-symbolic numbers (e.g. Chen and Li, 2014). Very few studies, however, have investigated ANP skills in the context of risky decision making and have analyzed direct associations among the aforementioned sub functions. Possible interactions between the closely related skills have not been considered. The current study (N = 128) examines interactions of ANP skills with executive functions and objective numeracy, in predicting risky choice behavior. ANP skills are represented by the accuracy in a dot-comparison task. Decision making is measured by two versions of the Game of Dice Task (GDT), which place different emphases on the reflection of potential risks. The results show two-way as well as three-way interactions between the measures of ANP skills, executive functions, and objective numeracy in predicting risky decisions in both GDT versions. The riskiest decisions were most frequently made in case of low scores in all of the three competencies, while good performance in any one of them resulted in significant reductions of disadvantageous decisions. The findings indicate that high ANP skills can positively affect choice behavior in individuals who have weaknesses in reflectively attributed skills, namely executive functions and objective numeracy. Potential compensatory effects and mechanisms of ANP in decision making are discussed. (shrink)

I present three versions –Grimm, Offe and Streeck—of a general argument that is often used to establish that the EU-institutions meets a legitimacy-disabling condition, the so called “no demos” argument (II), embedding them in the context of the notorious “democratic deficit” suspicions against the legal system and practice of the EU (I). After examining the logical structure behind the no-demos intuition considered as an argument (III), I present principled reasons by Möllers and Habermas that show why the “no demos” argument (...) fails to have bite in discussions of the legitimacy and status of the supranational level in the multi-level EU-architecture. These are complemented by another principled reason arising from John Dewey’s conception of the “public” as a clearer alternative for the “popular” requirement of democratic legitimation (IV). I conclude that all three conceptions together suggest that the hunt after pre-politically existing peoples as foundations of democratic legitimacy expresses no more than methodological nationalism without any footing in the material and conceptual requirements of democratic legitimation. Given the absence of a principled problem with the legitimacy of the priority and interference of supranational EU-law in the national legal and political orders, there are thus also no principled reasons to abandon or discredit the European project in the absence of a European nation or society. Marx’s theory of ground rent has been widely used to help understand the trinity of land, labor, and capital. However, limited attention has been paid to the role of water within the Marxian rent framework. This lack of attention proves troubling due to the role of surface waters as an essential means of production throughout capitalism. Here I restate Marxian ground rent in the form of water rent and discuss the function of water-rent in the two dominant surface water rights (...) doctrines of the United States—the riparian doctrine and the doctrine of prior appropriation. In doing so, I revise the distinction between differential rent 1 and differential rent 2 to provide more analytically useful categories. Paying special attention to issues of drought and scarcity, I fully articulate the function of Marxian rent and its four forms for both surface water rights doctrines, while clearly stating where they do and do not differ. Quine claims that holism (i.e., the Quine-Duhem thesis) prevents us from defining synonymy and analyticity (section 2). In Word and Object, he dismisses a notion of synonymy which works well even if holism is true. The notion goes back to a proposal from Grice and Strawson and runs thus: R and S are synonymous iff for all sentences T we have that the logical conjunction of R and T is stimulus-synonymous to that of S and T. Whereas Grice and Strawson (...) did not attempt to defend this definition, I try to show that it indeed gives us a satisfactory account of synonymy. Contrary to Quine, the notion is tighter than stimulus-synonymy – particularly when applied to sentences with less than critical semantic mass (section 3). Now according to Quine, analyticity could be defined in terms of synonymy, if synonymy were to make sense: A sentence is analytic iff synonymous to self-conditionals. This leads us to the following notion of analyticity: S is analytic iff, for all sentences T, the logical conjunction of S and T is stimulus-synonymous to T; an analytic sentence does not change the semantic mass of any theory to which it may be conjoined (section 4). This notion is tighter than Quine's stimulus-analyticity; unlike stimulus-analyticity, it does not apply to those sentences from the very center of our theories which can be assented to come what may, even though they are not synthetic in the intuitive sense (section 5). Conclusion: We can have well-defined notions of synonymy and analyticity even if we embrace Quine's holism, naturalism, behaviorism, and radical translation. Quine's meaning skepticism is to be repudiated on Quinean grounds. (shrink)

Mueller (bio)Michael Hogue’s American Immanence draws from some of the fundamental features of American philosophy: philosophy is not alienated from life, but rather, part and parcel of the structure of our experiences, a way of living. His notion of “resilient democracy” is particularly representative of this tradition of thought. Resilient democracy is, first of (...) all, an ethos, grounded in “the collective experience of uncertainty and animated by the living desire to bring about a more beautiful world.”2 This ethos is an associational, relational one, and it is democratic because, for Hogue, it must be “empathetic, emancipatory, and equitable,” assuming that each member of the association can be enriched by other members” (AI, 172–73). Vital to this democratic ethos is its anti-foundational politics; we start not with an immutable reality, but rather with the vulnerable reality of our actual, political, experiences (AI, 176). We start with where we are, not where some abstract ideal demands we should be. Democracy, for Hogue, is not just a certain political ideal for which to aim, but rather a way of being, a way of life. Dewey writes:A democracy is more than an associated form of government; it is primarily a mode of associated living, of conjoint communicated experience.... These more numerous and more varied points of contact denote a greater diversity of stimuli to which an individual has to respond... They secure a liberation of his powers which remain suppressed as long as the incitations to action are partial, as they must be in a group which in its exclusiveness shuts out many interests.3Throughout this paper, I use “democracy” in this sense; as a way of life, as a relational ethos, not as any particular political system. This feature of democracy is similar to the structure of Bildung, in which self-cultivation is both the process and the product.4 For example, for Wilhelm von Humboldt, an individual is in “continuing activity,” whose powers are never stagnant; humankind is always progressing, an infinite object.5 This is an end-in-view, not a fixed end.6 Humboldt “did not formulate a catalogue which prescribed what a person should know, what a person should read, what a person should have heard, what a person should have concerned himself with, so that one can say: this person has Bildung.”7 For Humboldt, Bildung is “the development of the capacities of the individual into a harmonious whole.”8 This paper, in part, looks at Hogue’s resilient democracy as a cultivation of both the individual and the group, as Bildung of both self and culture. In particular, the individual and culture that are being cultivated are relational, grounded in an emancipatory, equitable, and empathetic ethos, with a democratic way of life.Similar to the traditional Bildungstradition, education plays a vital role in this kind of democratic cultivation. If our end-in-view is a democratic society, then the method to reach that end must also be democratically ordered. Myles [End Page 41] Horton put it best: “When you believe in a democratic society, you provide a setting for education that is democratic.”9Modern Socratic Dialogue (MSD) is a particular method of philosophical dialogue that engages in and cultivates the ethos of resilient democracy. It cultivates empathy (in listening), pluralism (difference is accommodated and incorporated) and equity (insofar as no special knowledge is required), and anti-foundationalism (participants approach the conversation with epistemic humility, not trying to grasp a Truth as the ground of knowledge, but rather work together to form a common truth that comes out of their situatedness). These are all traits of Hogue’s resilient democracy, and all traits of an American Bildung, our self-correcting vulnerability, a way of being that replaces an unattainable ideal without sacrificing amelioration.Much like the tradition it addresses, this paper is layered; it is polyphonically pluralistic in method and structure. In this article, I argue that experimental ethics – like experimental economics – should also concern itself with field experiments. In particular, I defend two claims: a) that philosophers in normative ethics could considerably narrow down their disputes if they could agree on a wider range of socio-economic facts; and that b) the socio-economic facts that would be needed for this could only be generated by deliberate large-scale social experimentation. This essay normatively grounds my interest in special administration zones.

In this note i argue against harold n. lee's assertion ("mind," october, 1965) that resolution of zeno's paradoxes is closely connected with the modern mathematical distinction between density and continuity. zeno's paradoxes would arise as much if space or time is dense as they do if it is continuous. in fact the paradoxes only arise if one combines a mathematical analysis of space and time with a non-mathematical conception of motion.

Potential Perspectivism holds that what one ought to do depends on facts that are potentially accessible. Fassio argues against potential perspectivism based on cases of conjunction agglomeration failure of facts that are potentially accessible. I offer a refined account of potential perspectivism that handles cases of conjunction agglomeration failure by spelling out the notion of a potential perspective in terms of sets. Recently, Kenneth Westphal has presented a highly interesting and innovative reading of Kant's critical philosophy.2 This reading continues a tradition of Kantscholarship of which, e.g., Paul Guyer's work is representative, and in which the antiidealistic potential of Kant's critical philosophy is pitted against its idealistic selfunderstanding. Much of the work in this tradition leaves matters at observing the tensions this introduces in Kant's work. But Westphal's proposed interpretation goes farther. Its attractiveness derives for the most part from the promise that (...) it permits an internal critique of Kant's transcendental idealism (TI), that is, a critique that is based on the very resources of Kantian transcendental philosophy.3 In contrast to these resources, which currently seem to go through a sort of revival in an enormous array of fields, TI is notorious for dismaying even sympathetic interpreters. How attractive and needed such an internal critique of TI would be becomes all the more patent when we place such a promise in the context of some of the contemporary discussions about TI after Allison's famous defense of it. Before directly engaging with Westphal's interpretation, I would therefore like to quickly sketch on what background it acquires its force (I). After characterizing the main features of Westphal's view (II), and supporting it in more detail by an account of Kant's theory of cognitive significance (III), I then want to review the extent of its success to present Kant as issuing an anti-skeptical argument (IV.1), or semantic views that are incompatible with TI (IV.2), or a 'proof of not merely empirical realism' (IV.3). This article examines some arguments in favor of taking peace as a political obligation that can be found in one of the most important founders of the pacifist movement, Jane Addams. The main focus is on her 1907 book Newer Ideals of Peace, which has often been read as idealistic and outdated, and above all, as more of an activist’s manifesto than a serious contribution to either political philosophy or political theory. I point out that this owes much to an (...) ambiguity of Addams’ criticisms of the traditional and Kantian cosmopolitan defense of peace as a political ideal, the ambiguity between practical-political and conceptual problems. However, Addam’s succeeds in identifying one profound problem for traditional, even enlightended institution-centered ideals of peace, the collapse of the very ideal in cases of breaches of explicit peace-agreements among nations, because breaches of agreements are tantamount to the loss of all commitment to the other nation’s rights. It reveals that the conditions imposed by such ideals are at most necessary, but not sufficient for peace, and hence that the concept based on them is not a complete concept of lasting peaceful conditions among humans. Once it is seen as dedicated to resolving the problems entailed by this fundamental problem, Addams’ work, and in particular her focus on resources of solidarity and right-granting practices beyond and outside explicit agreements between governments can be understood as the development of a more adequate, coherent and comprehensive, while also a more actionable conception of peace. In the course of this development, Addams can also be observed to make use of crucial epistemological and more technical philosophical tools that are most closely associated with classical pragmatism, but which partly appear (albeit largely obliquely in the course of their application to a particular case) for the first time Addams’ treatise. Addams’ work is therefore of more than merely political activist interest for philosophers. Nonetheless, the article also explains her status as an important contributor to proper conceptions of world peace and the understanding of certain phenomena in the organization of public will formation precisely by pointing out that without some of her future-oriented proposals, like the inseparability of peace-policies and development, or the need to institutionally protect and foster spontaneous solidary action, the best contemporary work on peace would not have been possible. The migration debate highlights a crucial shortcoming of non-ideal theory. Non-ideal theory, this essay argues, is in a sense still too ideal. The open border approach to minimal global justice reveals that non-ideal theory is missing the appropriate tools for engaging moral problems that are brought about by a thorough lack of empathy. To remedy this flaw, I conceptualize a two-tier approach to nonideal theory. The basic idea behind the two-tier approach is adding the toolset of instrumental morality to non-ideal (...) theory. Instrumental morality, I argue, should take center stage whenever standard non-ideal theory fails to accomplish its task. Applying the approach to global justice, the article will make the case for charter cities. The policy of creating charter cities is built on the insight that in a world plagued by limited empathy, justice must be advanced in accordance with and not against the existing interests. (shrink)

Amartya Sen has demonstrated a possible inconsistency between a (liberal) right and Pareto optimality. Neither Sen nor the subsequent literature have discussed the origin of the rights that lead to the liberal paradox. In this article I examine one possible origin of rights definitions-a constitutional contract agreed to by all members of the community. Constitutional rights are show to be vulnerable to a similar paradox as with liberal rights, but if the writers of the constitution were correct in their choice (...) of actions to protect, such paradoxes will be unlikely and involve small welfare losses when they do occur. The article demonstrates that both the origin of rights and their potential role in advancing the interests of citizens can be explained using a utilitarian/welfarist methodology. (shrink)

In this chapter I review some of these publications. The review begins with The Calculus, and then goes on to The Limits of Liberty, The Power to Tax, The Reason of Rules, Politics by Principle, Not Reason, and essays about the importance of constitutions in the European Union. This article puts forth Modern Socratic Dialogue as a pedagogical tool for cultivating an American Bildung. Beginning with Michael Hogue’s work on “resilient democracy,” an associational ethos that is vulnerable and based on our lived uncertainty. To further establish this American Bildung, I investigate what it means to be American. Drawing from the works of Michael Walzer and Gloria Anzaldúa, I establish that “American” means unfinished, pluralistic, and embraces ambiguity. The question of how to cultivate this pluralistic, ambiguous, and vulnerable (...) Bildung is framed by the freedom and social bonds of Wilhelm von Humboldt’s theory of Bildung. For an American Bildung to flourish, freedom and social bonds can be presented and practiced in the form of Modern Socratic Dialogue – “truths” are created by the community of interlocutors, and problems and solutions are based on the experiences of the participants. This article investigates the relation between freedom, the public use of reason, and sensus communis, as discussed throughout Kant’s political writings and critical works. Kant’s discussion of the public use of reason, as put forth in "What Is Enlightenment?" is closely tied to his views on autonomy, most notably in the political sphere. However, Kant’s distinction between the public and private uses of reason relies upon sensus communis as discussed in the Critique of Judgment. The communicability achieved by sensus communis (...) has a relevance not restricted only to Kant’s explicitly political writings; sensus communis is also what we might call “transcendentally significant.” In this article, I argue that the public use of reason—a use of reason achieved by sensus communis—is vital for reason itself to follow its own normative demands. I conclude that sensus communis itself grounds reason’s use for its own critique. (shrink)

While readers of Euripides' Hippolytus have long regarded Phaedra's deltos as a mechanism of punitive revenge, I argue here that the tablet models itself on a judicial curse (defixio) and that its main function is to ensure victory for Phaedra in the upcoming “trial” over her reputation. In support of my thesis I examine three interrelated phenomena: first, Hippolytus' infamous assertion that his tongue swore an oath while his mind remains unsworn (612); second, Phaedra's status as a biaiothanatos; and third, (...) Phaedra's claim that Hippolytus “will learn sophrosune” (731), a speech act that, I conclude, anticipates the silencing effect on Hippolytus of Phaedra's death and her writing. (shrink)

The basic hypothesis of this book is that linguistic reference to kinds should be seen as reference to sortal concepts, i.e. cognitive categories for identifying and classifying objects. Viewed that way, kinds serve as the interface between the conceptual system and the grammatical system. Kind-level predicates differ as to whether they presuppose (e.g. to be extinct) or entail (e.g. to invent) the existence of objects, with crucial consequences for the interpretation of indefinite argument noun phrases. Moreover, object reference always involves (...) underlying kind reference, but kind reference does not always involve object reference. This asymmetry, once recognized, proves useful in solving otherwise puzzling problems in semantic composition. (shrink)

ABSTRACTTimothy Williamson recently argued that the notion of epistemic rationality is ambiguous between a Content-oriented schema and a Disposition-oriented schema. I argue that the Disposition-oriented schema suggested by Williamson is not faithful to the main idea behind it and that it should be replaced with the Disposition-Manifestation schema. This replacement suffices for avoiding Williamson's ambiguity thesis.

In the first part of chapter 2 of book II of the Physics Aristotle addresses the issue of the difference between mathematics and physics. In the course of his discussion he says some things about astronomy and the ‘ ‘ more physical branches of mathematics”. In this paper I discuss historical issues concerning the text, translation, and interpretation of the passage, focusing on two cruxes, the first reference to astronomy at 193b25–26 and the reference to the more physical branches at 194a7–8. In (...) section I, I criticize Ross’s interpretation of the passage and point out that his alteration of has no warrant in the Greek manuscripts. In the next three sections I treat three other interpretations, all of which depart from Ross's: in section II that of Simplicius, which I commend; in section III that of Thomas Aquinas, which is importantly influenced by a mistranslation of, and in section IV that of Ibn Rushd, which is based on an Arabic text corresponding to that printed by Ross. In the concluding section of the paper I describe the modern history of the Greek text of our passage and translations of it from the early twelfth century until the appearance of Ross's text in 1936.
